Notarial deeds (1861–1925)

The rules governing the preservation of notarial deeds are laid down in the Consular Regulations of 1868, articles 205 et seq. Their application resulted in the creation of a substantial collection of deeds.

The structure of the collection follows the provisions of the Consular Regulations.

  • Article 205 requires that deeds be bound in chronological order and entered into the collection within 24 hours of receipt
  • Article 206 provides that all sheets, including blank ones, be numbered
  • Article 210 prescribes that a register of deeds be placed at the beginning of the minute book. The volumes contain the deeds in chronological order.

Article 20 of the Consular Law of 28 January 1866 no. 2804 establishes that consuls hold the capacity of notaries with respect to nationals. The consul therefore acts as a notary, drafting, authenticating and preserving deeds. The consul receives wills, both public and secret; draws up protests for non-acceptance or non-payment; authenticates commercial books; issues certified copies of deeds executed or deposited with the Chancellery; and provides translations of documents from the language of the place of residence.
